ADMINISTRATIVE HEARINGS FOR DUI CHARGES

You only have 10 days to request an administrative hearing when you are charged with a DUI, and if you do not request the hearing, your license will be automatically suspended.

Therefore, if you have been arrested for DUI, you need to take action immediately.  Roy Yunker Law will prepare the Administrative Hearing Letter for you free of charge in our initial consultation meeting, whether or not you actually hire us.  If you don’t hire us, you will receive notice of the hearing to your home, and you will be responsible for all further responses to the DDS and the court system.

AUTOMATIC SUSPENSION

The Georgia DUI statute (O.C.G.A. 40-6-391) doesn’t complete the pain and suffering for someone who is convicted of Driving Under the Influence.  The punishment continues from the Georgia Department of Driver Services.

  • A refusal to take a chemical test (commonly known as a breathalyzer) when stopped under suspicion of a DUI will result in an automatic suspension of your license.
  • Any conviction under the Georgia Controlled Substances Act will result in an automatic suspension of your license.
  • A conviction for Driving Under the Influence will result in an automatic suspension of your license.

POINTS ON YOUR LICENSE

A driver who accumulates 15 points over 2 years will have his/her license suspended by the Department.  You can apply for point reduction once every 5 years, and once you complete a certified Defensive Driving course, the Department will reduce your point total by up to 7 points.

You actually don’t get any points added to your license for a DUI conviction, because that violation has its own series of more serious punishments imposed.
